SMS Program Terms

This is the text-messaging (“Text Series”) program of the healthcare practice you enrolled with (the “Practice”), powered by Social Cascade, Inc. (“Social Cascade”) as the technology and delivery platform. The Practice is the sender of the messages you receive.

The messages are for general educational and program information only. They are not medical advice and are not for emergencies. If you have a medical emergency, call 911 or your local emergency number. Messages must not contain protected health information (PHI) or other Sensitive Information such as Social Security or financial account numbers, and you should not send such information by text.

The educational content is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions about a medical condition.

You opt in by (a) entering your mobile number on a learnmore.health enrollment page and checking the unchecked consent box agreeing to receive recurring automated texts from the Practice, and/or (b) texting the published keyword to the program number. Where a confirmation step applies, you reply YES to complete enrollment. By opting in, you agree to these Terms and the SMS Privacy Policy.

An enrollment page may also offer a separate, optional box agreeing that the Practice may see which pages and videos you open from its text messages, linked to your phone number. That box is unchecked by default, it is not part of your consent to receive messages, and leaving it unchecked does not affect enrollment or the messages you receive. Your Practice may instead have obtained this consent from you directly — for example on a form you completed at the practice — in which case it records that consent on your behalf. Either way it is separate from your consent to receive messages, and you can withdraw it at any time without unsubscribing, using the link at the bottom of any program page. See Section 4 of the SMS Privacy Policy.

Message frequency varies. Message and data rates may apply. Consent to receive messages is not a condition of receiving healthcare services.

Reply STOP at any time to unsubscribe; you will receive a single confirmation and no further messages unless you re-enroll. STOP also ends any page and video tracking linked to your number. Reply HELP for help. Reply START to re-subscribe after opting out.

Message delivery depends on your mobile carrier. Carriers are not liable for delayed or undelivered messages.

The Practice is responsible for the content of its messages. Social Cascade provides the platform and delivery infrastructure and compliance tooling; it does not author the Practice’s message content. To the extent Social Cascade handles protected health information for a Practice, it does so as that Practice’s business associate, in accordance with HIPAA and any applicable business associate agreement. See Section 3 of the SMS Privacy Policy.

THE SMS PROGRAM AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCIAL CASCADE DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY, SECURITY, OR COMPLETENESS OF THE PROGRAM OR ITS CONTENT. If you are dissatisfied with the program, your sole remedy is to stop using it and reply STOP.

IN NO EVENT SHALL SOCIAL CASCADE’S AGGREGATE LIABILITY TO ANY INDIVIDUAL SUBSCRIBER IN CONNECTION WITH THE SMS PROGRAM EXCEED THE LESSER OF (I) $50 AND (II) THE TOTAL AMOUNT THAT YOU PAID TO US FOR THE PROGRAM. IN NO EVENT SHALL WE BE LIABLE TO YOU FOR ANY PUNITIVE, CONSEQUENTIAL, SPECIAL, AND/OR INDIRECT DAMAGES. Any claim or cause of action by you must be brought within one (1) year following the occurrence of the event resulting in such claim or action.

You agree to indemnify, defend, and hold harmless Social Cascade and its affiliates and each of their owners, members, directors, officers, employees, agents, and representatives from any claim, cause of action, proceeding, liability, damages, loss, attorney fees, cost, and expenses arising from or related to (i) your breach of these Terms or (ii) your use of the SMS program.

To the extent permitted by law, these Terms and your use of the SMS program are governed by the laws of the State of North Carolina, without giving effect to its conflict-of-law provisions.

Any controversy or dispute between you and Social Cascade arising out of or related to these Terms or the SMS program that cannot be settled by mutual agreement shall be exclusively and finally settled by arbitration before the American Arbitration Association (AAA) in Raleigh, NC. You and we agree that any claim shall be brought in the party’s individual capacity and not as a plaintiff or class member in any purported class or representative proceeding, and that by agreeing to these Terms both parties waive the right to seek remedies in court, including the right to a jury trial.

These SMS Program Terms govern the SMS program for subscribers. The Social Cascade Platform Terms of Service and Platform Services Agreement govern a Practice’s use of the Social Cascade Platform and are separate agreements. These subscriber terms are not a substitute for, and do not replace, those Platform agreements.

You may not assign your rights under these Terms; we may assign ours. If any provision is held unenforceable, the remaining provisions remain in effect. Together with the SMS Privacy Policy, these Terms are the entire agreement between you and Social Cascade concerning the SMS program.
